Sen Byron Dorgan (D-ND) announces he will not run in 2010…

A nice guy who seemed to really care about the middle class. Dorgan was the force behind the numerous attempts to pass Drug Reimportation so Americans who lose their jobs can still afford their life saving meds while unemployed….Our many posts on that Amendment and Dorgan here

Obama and Rahmbo smacked Dorgan down HARD on this. Obama sold out Americans to big PhaRMa and Billy Tauzin (BEHIND CLOSED DOORS!) when he began his ‘reform’ of health care….GOP Senators crossed the aisle to vote YES on RX REIMPORTATION and DEMOCRATS KILLED IT.

Here is Dorgan’s statement. Frankly that’s a big part of why I think he’s leaving, why fight a death match in ’10 to stick with a bunch of sell out corpocrats?

Twitter Feed Roundup courtesy of AllahPundit at HA who has an analysis up (go read it!):

markos Dorgan retirement is a huge blow to Dems.

jaketapper ND Dem Sen Dorgan’s retirement is horrible news for Democrats + may v likely mean an attempt to end 60-vote cloture requirement

mkhammer RT @mikememoli: Dorgan first non-appointed Democratic Senate incumbent to pass on 2010. Dodd next?

mattklewis If Hoeven runs, he’s in. If not, a strong GOP bench includes: Drew Wrigley, Kevin Cramer, Ed Schafer, Stenehjem, Clayburgh, Berg, et al.

stevebruskCNN One poll last month had suggested Dorgan could face a tough race if Republican Gov. John Hoeven did challenge him in 2010

AmandaCarpenter Dorgan says he wants time to write books, teach and… “would also like to work on energy policy in the private sector. ” http://ow.ly/T7cr

marcambinder She’s the (Cook Rpt) expert —> RT @jennifereduffy: More ND Sen: Dems will need a star to make this competitive and the pickings are slim.

marcambinder Biggest effect of the Dorgan retirement is not in the numbers per se; it’s about social psychology. Dorgan’s decision may push other Dems..

marcambinder Hoeven will now almost certainly run; it’s hard not to assume that, absent a stellar candidate, Republicans will pick up this Senate seat.

chucktodd Dorgan retirement means Dems will have hard time maintaining 60 seats going post-10. Dems have pulled ND rabbits out of hat b4 but…

chucktodd A gut punch to Senate Democrats: Byron Dorgan is retiring instead of running for re-election. ND SEN best 2010 pickup opp, hands down.

Update: Obama: I beg your pardon, I never promised you a …Public Option

Update 2: HotAir links Jake Tapper demolishing the BS from Camp Obama on his campaign promises on the P.O. and mandates.

Update: Obama says he did not campaign on the P.O. and that the Senate bill has all he wanted, okay let’s go to the tape as Howard Cosell would say:

…M’kay..… but yes Obama, yes in fact you DID campaign on a P.O. and so did your OFA website. My fave Dem POTUS Big Dawg lied about a bj, this ‘Dem’ POTUS lies about the centerpiece of health care reform we have worked for for DECADES. I find that a fitting summary of these 2 POTUS’ and which one is really trustworthy with the things that matter most to the lives of the American people…. YMMV….

FDL is loaded for bear and has all the many videos and web pages where Obama DID in fact promise a Public Option despite his apparent early onset Alzheimers in his WaPo interview (No offense to those suffering from Alzheimers)…

How does he lie to us, let us count the ways….no tax increase if you make under 250k HA!!!, no tax on health insurance premium deductions from payroll…check! make 86k? No subsidies AND a whopping excise tax on your family plan! Unless you are in a Union which is EXEMPT or in a SPECIAL state, one of 17 which are EXEMPT…

No individual mandate but a strong employer mandate..check! an individual mandate complete with IRS fines and penalties/granishments AND you get to insure your ADULT children through age 27 at least!(because nothing says you’re part of the dynamic generation of ‘progressive creative class’ like living in your Hillary voting mom’s basement and making her pay for your health insurance ) but no worries NO strong employer mandate survived.

A public option to offer ‘choice and competition’ to ‘keep the insurers honest’..check! no P.O. he now claims he never even THOUGHT of a P.O.!!! “What is this P.O. of which you speak??” AND no interstate competition, instead we get an insurer monopoly that holds us all hostage with a mandated product!

Prescription reimportation and bulk negotiations on RX rates in Medicare…check! WH killed Prescription Reimportation Dorgan Amendment and sold out to Big Pharma and Billy Tauzin in their very FIRST move on HCR, aka a big giant CLUE these guys were not going to ‘help’ consumers. Also the WH promised NOT to do negotiations on Medicare PT D drug prices!

You can keep your health insurance if you like it..check! Medicare Advantage, well if your Senator is a crony capitalist cutting deals in smoke filled rooms you might, just might get grandfathered in to keep your Advantage prices and bennies, ‘grandfathered’ get it, get it?! But the rest of the country is just frakked..and employer plans are expected to lower coverage levels to avoid the tax (per the CBO)

We could go on, but you get the point. It was the single biggest domestic issue on the Dem platform and it was tossed under the bus, overboard, onto the garbage heap by the MAJORITY, the DEMOCRATIC MAJORITY in the SENATE, THE HOUSE AND THE WH.

Remember it come Election Day, no matter which side of the aisle you are on, if any, this group of Democrats sold out American consumers and taxpayers and Seniors. Next they come for Social Security…..

Update: Passes 14-9 Health Care: Baucus about to pass bill out of SFC

2:54 pm EST: Passes out of SFC 14-9

Snowe only GOP vote for bill

Probably 14-9 or 13-10 of they count Lieberman as a Dem in the 13 Dems to 10 GOP ratio

Sen Kyl just revealed that the CBO score is based on a sheet of assumptions that SFC staff gave to CBO that are NOT voted on in Cmte. WTH!

Blanche Lincoln D NE indicates she will vote YES – big surprise, say goodbye to Blanche as she is booted out of office! Bob Beckel was on FOX a bit ago claiming she can keep her seat by voting yes for cloture to end debate on the bill (when it gets to the floor) and then vote no on passage when only 51 is needed to pass. Uhm no Bob, she is facing her constituents after this vote right here. That is enough to see where she stands.

Snowe R ME just said she will vote yes NOT a big surprise.

Well they are passing it. Let the truth and consequences begin. This should encourage healthy people to drop their coverage since insurers are now forced to cover them even if sick without the cushion of the universal mandate to spread the risk pool (no mandate until 2013). Totally counter-productive IMO.

2010 baby, it cannot come soon enough. AZ has a question on our 2010 ballot to protect us from the Federal mandates (in the event the opt out doesn’t make it into final legislation)

Let this be a lesson to those in American business who would deal with Team TOTUS. No deal is set in stone. Personally, I still await Billy Tauzin and big phaRma getting rolled, once they flip on that deal Seniors can reimport their rxs from Canada, and it will be sweet karma. Of course, Senior may find themselves on an American version of the NHS Liverpool Pathway soon enough anyway, God Bless.

Another apropos tune with the completely anti-health conscious Keith Richards, look at he and Ron smoking away, and they are living well today, go figure, rock on:

Jennifer Rubin on what’s to come:

As the New York Times reports, there is a jumbo fight brewing among Democrats over just how much they’re going to tax the middle class in the name of health-care reform. Senate Democrats want to tax so-called Cadillac health-care plans to pay for the gargantuan health-care bill, while House Democrats don’t think it’s a good idea to whack middle-class voters, and especially union members. Well, on this one, House Democrats have a point:

Big Pharma is frakked: Reid (D-NV) latest to say he is ‘not bound’ by WH drug deal; says he will use reconciliation if necessary…

BWAAAAHAAA!!! The sheer STUPIDITY of Billy Tauzin in believing ANY deal this WH cut with him is in full display yet again..if these maroons do the 150m ad buy to back Obamacare they are serious schmucks…

O’Jays courtesy of Dansaaid

See our previous posts on Tauzin and the deal only he and his bosses at big Pharma were stoopid enough to believe would stand here.

At this point, IMO, it really does not matter if Reid is obfuscating to his constituents to avoid telling them they did a ‘smoky room, closed-door!’  deal with Teh Evil ™ lobbyists and now seniors can’t negotiate RX prices or reimport RXs from Canada, (which was one of TOTUS main promises in the campaign), or if Reid and Congress really have an ‘understanding’ with the WH to either a, pretend they wont be bound by WH agreements, or b, be bound but act like they’re not. The bottom line is nothing Reid says is IMO believable or trustworthy. So of course none of us trust these guys to remake our health care…Vote him out NV!

Politico:

Senate Majority Leader Harry Reid said Friday that he was not bound by a controversial deal negotiated between the White House and pharmaceutical companies, telling thousands of Nevada voters on a conference call that “I have not agreed with anybody to do that.”

The drug industry told the White House this summer that it would cut future drug costs by $80 billion in exchange for assurances that any health care legislation would prevent the government from negotiating for lower drug prices. As a result of the deal, the industry is bankrolling an ad campaign touting Barack Obama’s health care overhaul.

But Democrats in Congress have balked at the agreement. “I’m a Democrat in the Senate, and I haven’t agreed,” Reid told a caller…

And of course in his usual TACTFUL way Reid reminded everyone that Teddy is gone and said he would use reconciliation, he also said, I kid you not, “there is nothing to pay for” in the public option?!?!? Wha??

…”There really is nothing to pay for,” Reid said of a public option. “It is an entity to set up to keep the insurance companies honest. There would be some small administrative costs.”..

Reid said that if Democrats can’t get bipartisan support, they would move the bill through the fast-track budget process, which cannot be filibustered. He said that is not their preference, but he predicted that three-quarters of the bill could be passed that way.

“Sen. Kennedy as you know is dead,” he said adding that with ailing West Virginia Senator Robert Byrd frequently absent, “We need Republican help, that’s why a bipartisan bill is important.”

Well now their failure is due to death and illness I see. Maybe next he will whip out a note from Epstein’s Mother…

Waxman prepares to roll big Pharma…

Ahh Billy, Billy. What were you thinking trusting any deal with this Administration? Tsk, tsk. Karmic backlash.

Ed has all the details at HotAir:

Barack Obama picked up considerable political support for his overhaul of the American health-care system by promising a limit on price concessions to the pharmaceutical manufacturers.  They signed onto ObamaCare after getting assurances that their givebacks would amount to no more than $80 billion over 10 years and that the federal government would not try to bargain for lower pricing using its advantage through Medicare.  Henry Waxman plans to renege on just about every aspect of that agreement:

As the health care debate focuses on whether cost cuts are looming in Medicare coverage, Representative Henry A. Waxman is on a crusade to save Medicare billions of dollars — in a way that he says would end up helping the elderly.

That is because the money would come from the drug industry, which is why Mr. Waxman may have a fight on his hands.

Drug makers contend they have already worked out a 10-year, $80 billion cost-savings deal with the White House and crucial Senate gatekeepers on the trillion-dollar health care overhaul. The industry says that trying to add Mr. Waxman’s provision could scuttle that agreement.

“You not only break the deal, but you break the bank for us,” said Billy Tauzin, chief executive of the drug industry’s trade group, the Pharmaceutical Research and Manufacturers of America, known as PhRMA….

Cry me a river Billy you jaggoff. Pharma has the biggest profit margin of all the playas in this line of business and they were skating away, just like they did on Medicare PT D, and leaving Americans to bear the brunt of a POS reform package in some kind of frakkin protection racket they have going up in the Oval these days…Nice little pill business you have there, shame if anything were to happen to it…as we have said here numerous times, if he sold out Americans for 150m ad deal in exchange for ‘protection’ from the jackboots running the House right now he is a fool.

Update: Sunday Chatter: Kent Conrad (D-ND) and Sebelius both back off public option: the Federally funded co-op is now the term of choice…(and with Federal Funds it will still kill private insurance)

Update: Monday 8/17: Just like the Clash, Team TOTUS is unsure if they should stay or go on public option lol, they are releasing spin via Ambinder (who failed to get their ‘townhalls folks are hurting the GOP side’ meme to take effect, but not for lack of trying on his part, lol), that Sebelius ‘misspoke’, then another WH aide, off record OF COURSE! said no she didn’t misspeak, the MEDIA misrepresented what she said..uhm yeah okay go with that…YOU CANNOT TRUST ANYTHING THESE GUYS SAY PEEPS…GET IT IN WRITING BIG PHARMA, Dumb bunnies…..

An administration official told Marc Ambinder that HHS Secretary Kathleen Sebelius “misspoke” when she told CNN that a government run health insurance option “is not an essential part” of reform.

“This official asked not to be identified in exchange for providing clarity about the intentions of the President. The official said that the White House did not intend to change its messaging and that Sebelius simply meant to echo the president, who has acknowledged that the public option is a tough sell in the Senate and is, at the same time, a must-pass for House Democrats, and is not, in the president’s view, the most important element of the reform package.

See you at the RECESS RALLY!!!!

And it means nothing because we can trust them about 1/4 as far as we can throw them, although I think I could throw them pretty far….especially if we started with Jaeger shots…(just sayin’)….but it is a sign of cracks in the facade of happy changey hopey dopey land….

Conrad has been pushing co-op but FEDERALLY FUNDED so it is in effect a frakkin PUBLIC OPTION…maroons…

If they want small groups to be able to pool risk and premiums go with Multiple Employer Trusts which I used to process claims for in TX, this way small business gets group rates, NO PUBLIC MONEY REQUIRED….

Free interstate insurance commerce from Federal red tape! ….geez it would be simple were they not trying to Trojan Horse a single payer plan through wouldn’t it? Wyden-Bennett would work….but NO CO-OP GOVT PLAN BY ANOTHER NAME…frakkers…

TheHill:

A public health insurance option took more hits Sunday as Sen. Kent Conrad described its pursuit as a “wasted effort” and an administration official said it is not an “essential” part of reform.

Conrad (D-N.D.), who supports setting up health insurance co-operatives with government seed money to compete with private insurers, described the public option as all but a lost cause.

“Look, the fact of the matter is there are not the votes in the U.S. Senate for the public option, there never have been,” Conrad said in an interview on “Fox News Sunday with Chris Wallace.”  “So to continue to chase that rabbit is, I think, a wasted effort,” Conrad said.

His comments followed Health and Human Services Secretary Kathleen Sebelius’s remark that a public option is “not the essential element” to ensure competition in the health insurance market. Sebelius made the remark on CNN’s “State of the Union,” according to a report in the Associated Press….

Gee, TOTUS has been saying ad nauseum that the public option IS necessary to do just that, ensure competition. On which I call BS…

Question, if there is no yearly or lifetime claims max on people and you cannot pre-ex them or drop their coverage, how can you possibly have enough cash reserves from premiums and ROI (return on investments) to cover pending and potential future claims?

Update: One Night Only! Dorgan & McCain LIVE from the Senate floor team up in support of the Drug Reimportation Amendment….

Update: Shows Added, lol! Even AP notes OBAMA is blocking this billions in savings for American consumers. Debate continues today:

A bipartisan group of lawmakers hopes to finally win a long struggle to ease curbs against importing low-cost prescription drugs but will have to overcome the Obama administration and the pharmaceutical industry to do so. The Senate was resuming debate Thursday on President Barack Obama’s drive to reshape the country’s care system. The most crucial work was being done behind closed doors, where Senate Majority Leader Harry Reid, D-Nev., and his lieutenants were hunting support for a tentative deal among moderate and liberal Democrats to expand the government’s role in providing care.

As predicted Team Obama has SOLD US DOWN THE RIVER for Pharma and Billy frakkin Tauzin. The FDA released a letter OPPOSING the Amendment allowing the reimportation of prescription drugs for American consumers. Obama is AGAIN betraying a promise he made throughout the campaign. This is one of the single biggest cost saving expenses for Americans in their healthcare costs. The FDA has the AUDACITY to claim drugs coming from CANADA are not SAFE!! HA!! Dorgan and MAC teamed up in a great vaudeville style debate today, punching holes in the ridiculous FDA statement..

WSJ:

…Allowing importation of prescription drugs from a select few countries such as Canada, Ireland, and parts of Europe could lower prices in this country, and Dorgan has an amendment to the health-care bill that would legalize the practice.

Tuesday, the FDA blew a hole in his amendment. In a letter, FDA Commissioner Peggy Hamburg said importing drugs would be unsafe, too complex and too expensive. The drug industry has also opposed the practice, pointing out that Europe, which allows some importation, has problems with counterfeit drugs.

On the floor of the Senate today, McCain played the set-up man, lobbing rhetorical softballs for Dorgan. Here’s a much-condensed version of some of the highlights. Watch the whole thing yourself, starting around minute 270 in this C-Span video

McCain: Isn’t it true that a letter was written to one of our colleagues from the administrator of the FDA?

Dorgan: The Senator from Arizona is correct. They say “We don’t have the resources.” This amendment provides the resources for them. The people that are selling [imported drugs] will pay a fee.

McCain: It requires no additional funding from the taxpayer?

Dorgan: No additional funding from the taxpayer at all!

McCain: Could we say it would not propose any hazard to anyone’s health?

Dorgan: The countries that are involved in this amendment — and they are limited — are countries that have an identical chain of custody to our country.

On a roll now, Dorgan holds up two pill bottles and continues:

Both of these bottles contained Lipitor — most of my colleagues know what Lipitor is. And this was made by an American company in Ireland and shipped all over the world. This little bottle was shipped to the United States. This little bottle was shipped to Canada. What’s the difference? The price. The American consumer is told, guess what you get to do? You get to pay almost triple.

McCain: On behalf of the citizens of my state, I just want to say, thank you for your advocacy.

Update: Sen Carper confirms quid pro quo! Is Pharma the Chamberlain of the health care wars? YES!!!: Boehner to Big Pharma: Don’t be an appeaser….

Update: Courtesy of HA, Sen Carper CONFIRMS the quid pro quo deal b/w phaRma and TOTUS for the ad buy. He is actually whining about it, apparently not grasping the IMMORALITY snd perhaps ILLEGALITY of the deal. He is upset that Baucus isn’t sticking to the right $ figure! What a maroon!

Okay Seniors, it is up to you. TOTUS promised you could buy RXs from Canada and he sold you down the river for a 150m ad buy and buy in from phaRma for reforms.

CALL YOUR CRITTERS! JUST SAY NO TO THE QUID PRO QUO!

Right on John!

Politico:

In a scathing, borderline condescending, “dear colleague,” Boehner urged Tauzin to unwind PhRMA’s deal with President Barack Obama and Senate Finance Committee Chairman Max Baucus (D-Mont.) to support health care legislation in exchange for profit protection under rules established in the controversial 2003 prescription-drug bill….

…Drugmakers agreed to find tens of billions in savings in order to trim the federal government’s prescription-drug tab under Medicare in exchange for other protections, like allowing the industry to preserve a lucrative rebate structure under Medicare Part D and the White House’s agreement to oppose any move to force the government import lower-priced drugs from Canada. The industry also committed to spend $150 million to advertise in support of health care reform – although it has not yet endorsed any of the four bills to pass out of committee.

Boehner’s letter, which is excerpted after the jump, speaks for itself. But the central thrust is that PhRMA cut a bad deal, in large part, because Democrats will eventually renege, Boehner argues. It reads like a jilted lover laughing at his ex-girlfriend after she gets dumped by the replacement boyfriend. Check it out.

These are EXCERPTS of the letter:

“Dear Billy,

“Appeasement rarely works as a conflict resolution strategy. This is as true in the arena of policymaking as it is in schoolyards across America. When a bully asks for your lunch money, you may have no choice but to fork it over. But cutting a deal with the bully is a different story, particularly if the “deal” means helping him steal others’ money as the price of protecting your own.

“The simple truth is, two wrongs don’t make a right. And the short-sighted health care deal PhRMA struck with the Obama Administration at your urging provides confirmation of this time-tested maxim on an epic and tragic scale.

“The “bully” in this case is Big Government. At your behest, PhRMA has chosen to accommodate a Washington takeover of health care at the expense of the American people in hopes of securing favorable treatment and future profits. It’s a short-sighted bargain that leaves your own customers and employees behind. And it now has all the markings of a deal gone sour.
